By purchasing any products (the “Product”) and by using this Website you acknowledge that you have read, agree and will comply with these Terms & Conditions. Our Privacy Policy and Delivery & Returns information will be incorporated into this Terms & Conditions page.

1. Making a purchase

a) You should understand that by accessing this Website and/or placing an order, you agree to be bound by these Terms & Conditions and that you consent to us using your information in accordance with our Privacy Policy. If you do not accept these terms, please do not use the site.  
b) We are under no obligation to accept your order.
c) We will acknowledge by e-mail your order for a Product at the time you place your order. We will then notify you within 2 working days with a dispatch email if we have accepted your order.
d) In the event a Product is listed at an incorrect price due to a typographical error, we will notify you of the correct price by e-mail and we will give you the choice of either purchasing the Product at the correct price or cancelling your order.
e) Any order (whether or not accepted) is subject to availability of the Product. If the Product becomes unavailable prior to delivery we will notify you and give you the choice of a refund or of purchasing an alternative Product.

2. Our geological service

Our Website is at present only available for use by individuals resident in the United Kingdom. We reserve the right at any time to add, remove or otherwise vary the countries we sell too.

3. Your status

By placing an order through our site, you warrant that:
a) You are legally capable of entering into binding contracts.
b) You are at least 18 years.
c) You are resident within the United Kingdom.

4. How the contract is formed between you and us

a) After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the “Shipping Confirmation”). The contract between us (“Contract”) will only be formed when we send you the Shipping Confirmation.
b) The Contract will relate only to those Products whose shipping we have confirmed in the Shipping Confirmation. We will not be obliged to supply any other products, which may have been part of your order until the dispatch of such Products has been confirmed in a separate Shipping Confirmation.
c) In exceptional circumstances, if we are not able to fulfill an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email. In no circumstances will we be liable to you for any additional amounts.

5. Our status

We may provide links on our Website to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that Products you purchase from companies to whose website we have provided a link on our site will be of satisfactory quality and any such warranties are DISCLAIMED by us absolutely.

6. Price and payment

a) The price of any Product/s will be as quoted on our website except in cases of obvious error.
b) These prices include VAT but exclude delivery costs, which will be added to the total amount due.
c) Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Shipping Confirmation.
d) Online payment for all Product/s must be by credit or debit card.

7. Limitation of our liability

a) Whilst we have taken all reasonable steps to ensure the accuracy of the information on this Website, it is provided on an “as is” basis and we give no warranty and make no representation regarding the accuracy or completeness of the content of this Website. Further more, no warranty is given that the Website shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such unavailability.
b) Access to and use of this Website is at your own risk. We do not warrant that the use of this Website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data or computer virus infection. We accept no liability for viruses.

a) Your order will be fulfilled within a reasonable time of the date of the Dispatch Confirmation. We aim to dispatch goods in stock within 1 – 3 working days of receipt of order.
b) You must advise us of any non-delivered of goods within 5 days of dispatch.
c) From time to time delays in delivery are inevitable due to non-availability of products. If we are unable to deliver the goods ordered by you we will notify you or we may, at our discretion, supply or deliver a substituted product or refund any monies paid for such goods.
d) From time to time product specifications from a manufacturer may change. In such circumstances we will do our best to offer you a similar alternative. All sizes and measurements are as provided by the manufacturers specification. We cannot take any liability for the inaccuracy or otherwise in relation to any specifications or measurements provided by a manufacturer or other third party.
e) We will dispatch your order as quickly as possible, usually the day after it is received. Occasionally this may take longer if there are delays outside of our control in which case we will contact you and advise you fully.
f) Please quote your order number in all correspondence.

9. Risk

The Product/s will be at your risk from the time of delivery. Ownership of the Product/s will pass to you when we receive full payment of all sums due in respect of the Product/s, including delivery charges.

10. Defective and damaged items

Should you receive an item you have ordered that is defective, damaged or not what you ordered, please contact us as soon as possible. Please return any defective, damaged or incorrect item to us within 30 days of receiving the item. You may then choose to receive a replacement item, repair, exchange for an alternative item or refund. You will need to provide proof of purchase of the item.

11. Consumer rights / cancelling your order

a) You may cancel your order at any time, but please notify us within 30 days of receiving your order, the 30 days beginning on the day you place the order. You will receive a full refund of the price paid for the Product/s in accordance with our Terms & Conditions.
b) To cancel a Contract, you must inform us in writing. You must also return the Product/s to us as soon as possible, in the same condition in which you received them, in their original packaging and at your own cost and risk.
c) You have a legal obligation to take reasonable care of the products while they are in your possession.
d) If you cancel the Contract and then you receive the goods, you must not unpack them from their packaging, but must immediately send them back to us.
d) Provided that we receive the goods in the condition they were in when delivered to you, we will re-credit you with the amount payed for your order as soon as possible and within 30 days of your cancelling the Contract.

a) In the unlikely event that you are unhappy with your purchase, you have the right to cancel your order with us.  To do this, please notify us within 30 days of receiving the item by e-mailing us at [email protected] or calling us on 01308 868911.
b) You will need to return your item to us within 30 days of delivery, in its original packaging with proof of purchase, dispatch note or gift certificate and we will be happy to either exchange the item or refund the price paid.  You have a legal obligation to take reasonable care of the items when they are in your possession.
c) For hygiene reasons we cannot exchange or refund earrings.
d) Please note, if an exchange is required, your order will need to be refunded and a new order will be placed. Please contact us by e-mailing [email protected] or calling us on 01308 868911 and we will be happy to help you with this.

13. Customer responsibility

a) No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for Earth Design to sell items.
b) If you are under 18, you may use the site only with the permission of a parent or guardian.  
c) Product/s bought from our Website are not for resale.
